1. Agreement to Terms
These Terms of Service (“Terms”) are a binding agreement between you (“you,” “your,” or “Customer”) and Jokes on You, LLC, an Indiana limited liability company (“Jokes on You,” “we,” “us,” or “our”). They govern your access to and use of our website located at jokes-on-you.com and any related products, services, and content (collectively, the “Services”).
By accessing the Services, checking the box indicating your acceptance, or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Services or place an order.
2. Eligibility
You must be at least 18 years of age to use the Services or place an order. By using the Services, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms.
3. Description of Services
Jokes on You offers novelty and prank-themed products, which may include physical print-on-demand merchandise (such as apparel, mugs, posters, signs, and similar items), self-fulfilled physical items, and a digital “prank website” product.
The digital “prank website” is a single-page, classic “bait-and-switch”-style web page created for entertainment purposes. The page is designed as a one-time gag: it exists only until the recipient of the link views it, after which it is no longer available. You are responsible for how, and to whom, you distribute the link, and for ensuring your use complies with Section 4 (Acceptable Use and Prohibited Conduct).
We reserve the right to modify, suspend, or discontinue any part of the Services at any time.
4. Acceptable Use and Prohibited Conduct
Our products are intended for good-natured, lawful humor and entertainment. You are solely responsible for the content, targets, and consequences of any prank, order, or submission you create or request.
You agree that you will not use the Services, and will not use any product purchased from us, to:
- Threaten, harass, stalk, bully, intimidate, or incite violence against any person;
- Defame, libel, or knowingly spread false statements of fact about any person;
- Impersonate any real person or entity for the purpose of fraud, deception, financial gain, or to deceive others into believing false statements originate from that person;
- Reveal, publish, or threaten to publish another person’s private, personal, or identifying information (“doxxing”);
- Target, involve, or reference any minor in any prank or product;
- Infringe any third party’s intellectual property, privacy, publicity, or other rights;
- Violate any applicable local, state, federal, or international law or regulation; or
- Engage in any conduct that is malicious, hateful, discriminatory, or intended to cause genuine harm rather than harmless amusement.
We reserve the right, but assume no obligation, to review submissions and to refuse, cancel, modify, or remove any order or content, and to refuse service to anyone, at our sole discretion, including where we believe these Terms may be violated. We may report unlawful conduct to appropriate authorities.
5. Customer Responsibility and Indemnification
You alone are responsible for what you create and how you use our products. You acknowledge that Jokes on You provides tools and products for entertainment and does not control, and is not responsible for, the manner in which you use them or the effect they have on any third party.
You agree to indemnify, defend, and hold harmless Jokes on You, LLC and its members, managers, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services or any product; (b) any content or information you submit; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.
6. Orders, Pricing, and Payment
All orders are subject to acceptance by us. Prices are listed in U.S. dollars and are subject to change without notice. Payment is processed through our third-party payment processor; by placing an order you also agree to that processor’s terms. You are responsible for providing accurate order and shipping information.
Certain products include an optional custom design service for an additional fee, as described at checkout.
7. Refunds and Cancellations
Because our print-on-demand and custom products are made to order, and our digital products are delivered or produced upon purchase, all sales are final and non-refundable, except where an item arrives materially defective, damaged, or materially different from what was ordered due to our error. In such cases, contact us at contact@jokes-on-you.com within 3 days of receiving the product and we will, at our discretion, repair, replace, or refund the affected item.
8. Intellectual Property
All content on the Services that we own or license — including our name, logo, designs, text, and graphics — is the property of Jokes on You, LLC or its licensors and is protected by intellectual property laws. You may not use it without our prior written permission.
By submitting any content, design request, text, or other material to us (“Customer Content”), you represent that you have all necessary rights to do so, and you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and modify that Customer Content solely as necessary to fulfill your order and operate the Services.
9. Disclaimer of Warranties
THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOKES ON YOU, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY PRODUCT.
IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Vanderburgh County, Indiana, and you consent to the personal jurisdiction of those courts.
12. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date above reflects the most recent version. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
